Social Security Fairness Act: The Timeline and the Payouts
How a bill that failed for thirty years became law in January 2025, what SSA did next, and the dates that decide what you were owed.
This rule no longer exists
WEP and GPO were repealed on 5 January 2025
If you were reading this page because you expected your Social Security to be cut by a public pension, it is not. Both rules were abolished, the change was backdated to January 2024, and the Social Security Administration has already paid the difference to everyone it identified as affected.
“December 2023 is the last month that WEP and GPO will apply. This means that those rules no longer apply to benefits payable for January 2024 and later.”
Social Security Administration

- What it repealed
- Both the Windfall Elimination Provision and the Government Pension Offset (SSA Legislative Bulletin 118-13)
- Last month the rules applied
- December 2023 (SSA, Social Security Fairness Act)
- Back pay went back to
- January 2024, paid as a one-time deposit (SSA, Social Security Fairness Act)
- Paid out
- Over 3.1 million payments totalling $17 billion, completed 7 July 2025 (SSA press release, 7 July 2025)
One thing that still matters
“WEP and GPO still apply to months prior to January 2024.” So the old formula is not irrelevant history: it is what determines whether the one-time payment you received was the right amount. Our back pay calculator works out what you should have been owed, so you can check it against what landed in your account.
Sources last checked 30 July 2026. The rest of this page describes how WEP and GPO worked while they were in force, and is kept because the historical formula is what the back pay was calculated from.
The Social Security Fairness Act was signed into law on 5 January 2025. It repealed both WEP and GPO with effect for benefits payable for months after December 2023, so the correction was backdated to January 2024. SSA began adjusting monthly payments on 25 February 2025 and reported on 7 July 2025 that it had completed over 3.1 million one-time payments totalling $17 billion, five months ahead of its own schedule.
- 5 January 2025: signed into law as H.R. 82
- December 2023: the last month WEP and GPO applied to a benefit
- 25 February 2025: SSA began adjusting monthly benefit payments
- 7 July 2025: SSA reported the payment run complete, over 3.1 million payments totalling $17 billion
- Benefits payable for January 2024 would generally have been received in February 2024, which is the detail that decides your month count
Key Takeaways
- 1Signed 5 January 2025, repealing both WEP and GPO in one act
- 2Backdated to January 2024, not to the signing date
- 3SSA started monthly adjustments on 25 February 2025
- 4The one-time back payments were reported complete on 7 July 2025
- 5If you were entitled to a reduced benefit before 2024 and nothing arrived, that is worth raising with SSA

If WEP/GPO cuts your benefits, gold can help fill the gap.

Five dates cover the whole thing. The gap between the second and the third is where most of the confusion about back pay comes from.
- **December 2023**: the last month WEP and GPO applied to any benefit
- **January 2024**: the first month they did not, which is where back pay starts
- **5 January 2025**: the President signed H.R. 82, the Social Security Fairness Act of 2023
- **25 February 2025**: SSA began adjusting monthly benefit payments
- **7 July 2025**: SSA reported over 3.1 million payments totalling $17 billion, complete and five months early
What Changed For You
Two separate things happened: your monthly amount went up, and you were owed a lump sum for the months in between.
- **If you were already retired**: your monthly benefit was recalculated without the reduction
- **If you retire from here on**: the reduction is simply not in the formula any more
- **The lump sum**: covered the increase back to January 2024, deposited to the account SSA had on file
- **Spousal and survivor benefits**: GPO went with WEP, so those were restored too
- **How much**: it depended entirely on your own reduction, which is why we built a calculator instead of quoting an average we cannot source
Who It Applied To
WEP and GPO fell on people whose public employment sat outside Social Security. If that was you and you were drawing a benefit before 2024, you were in the group SSA paid.
- **Teachers**: in the states whose retirement systems are outside Social Security
- **State and local workers**: police, firefighters, transit workers
- **Federal CSRS employees**: the pre-1984 federal system
- **Railroad workers**: those with Railroad Retirement benefits
- **The published total**: SSA sent over 3.1 million payments, which is the only headcount here with a source behind it
Is WEP/GPO cutting into your expected retirement income?
WEP and GPO were repealed in January 2025, backdated to January 2024, so your Social Security is permanently higher than you may have planned for.
Why It Took Thirty Years
This matters for one practical reason: it explains why so much of what you will find written about WEP online is confidently wrong, and why you should check the date on all of it.
- **Repeatedly introduced**: versions of this bill were filed in Congress for about three decades
- **Passed the House, died in the Senate**: the usual pattern before 2024
- **Cost**: the price tag was the standing objection every time
- **The consequence for readers**: there are years of articles, and calculators, that say repeal will not happen, all accurate on the day they were written
- **Including ours**: this page said the same until 30 July 2026, when we corrected it against the SSA bulletin
The Dates That Decide Your Number
Most disputes about a back payment come down to counting months, and there is one detail that catches people out.
- **Start counting at January 2024**: that is the first month the rules no longer applied, not the January 2025 signing date
- **Mind the payment lag**: SSA notes that a benefit payable for January 2024 would generally have been received in February 2024
- **Stop counting when your monthly amount was corrected**: for most people that was on or after 25 February 2025
- **Multiply**: your old monthly reduction, times that month count, is roughly what the one-time deposit should have covered
- **Pension amount on file**: SSA needed your non-covered pension figure to pay the pre-2024 months correctly, and it says it will write to you if it needs an update

What to Do With a One-Time Deposit
A back payment covering more than a year of benefits is unusual money: it arrives after you have already balanced your budget without it, which makes it the easiest kind to put to work rather than absorb.
- Your Social Security is now permanently higher and it is inflation adjusted, which is the strongest income you have
- Most public pensions have limited or no cost of living adjustment, so that part still erodes
- Additional savings in a 403(b), 457 or IRA give you flexibility a pension does not
- If you want part of it in physical metal, a precious metals IRA is one option among several, and our reviews say plainly which providers publish their fees and which do not
- Watch for scams first. SSA warns about them on its own Fairness Act page, and it does not charge a fee to release this money
Frequently Asked Questions
1What date was the Social Security Fairness Act signed?
5 January 2025. SSA recorded it in Legislative Bulletin 118-13, dated 6 January 2025, which states that the law repeals both WEP and GPO and applies to benefits payable for months after December 2023.
2Why is the back pay dated to January 2024 and not January 2025?
Because the law is written to apply to benefits payable for months after December 2023, not from the date of signing. That is what makes the correction retroactive by about a year before the President even signed it.
3When did the payments actually go out?
SSA began adjusting monthly benefit payments on 25 February 2025, and reported on 7 July 2025 that it had completed over 3.1 million one-time payments totalling $17 billion, five months ahead of its own schedule.
4How do I check whether my payment was the right amount?
Multiply your old monthly WEP or GPO reduction by the number of months from January 2024 until your monthly benefit was corrected. Our back pay calculator does that arithmetic, and if the result is materially more than what you received it is worth raising with SSA.
